亚马逊店铺被停用账户,理由是欺诈性提交DMCA通知。目前店铺A和B都已下架,目前还没收到停用账号通知,我需要怎么做,才能逃过一劫? 店铺C被停用账户,这个问题要怎么处理?账户如何寻回?

我有3个店铺,分别店铺A、B、C,上架了同一款产品,12月初美国一家公司投诉我3个店铺的产品链接侵权.
 
然后我在12月底的时候店铺A尝试反通知申诉,在1月10日的时候通过并恢复ASIN了. 
 
接着我就让店铺B和C在1月10日当日以同样的方式提交了反通知,然后ASIN于1月28日也都恢复ASIN了 
 
1月31日的时候发现店铺C被停用账户了, 理由为欺诈性提交DMCA通知. 
 
其中店铺B是体量比较大的店铺,我现在担心因为这个反通知,三家店铺都会受到停用账户的处理,尤其 店铺B非常重要,店铺C被停用账户之后,店铺A和B已经立即下架了链接.
 
我需要得到的帮助是: 
1.店铺C被停用账户,这个问题要怎么处理?账户如何寻回? 
2.目前店铺A和B都已下架,目前还没收到停用账号通知,我需要怎么做,才能逃过一劫?

 欺诈性dmca,很难申诉,我查过死因,比较无解

注意看最后几个字,do not reins without legal approval,内部查死因的备注是,没有法律批准不得回复,申诉的话,必须走法律程序(真实不侵权,去起诉亚马逊)

或者权利人发给亚马逊撤诉,然后把撤诉信抄送给你,再去申诉,不然申诉就是会被拒绝
 
2.目前店铺A和B都已下架,目前还没收到停用账号通知,我需要怎么做,才能逃过一劫? 
 
被判dmca欺诈有以下3种情况:
1、链接确实涉嫌侵权,但还是提交了误导性信息的DMCA(反通知);
2、在提交DMCA(反通知)前,对链接进行了修改;
3、链接不清楚是否侵权,投诉人提供了法律等相关文件证明侵权;
 
dmca已经提交,这个已成事实,要想根本排除风险,需要专业律师去和对方沟通,做一个和解,并且双方签订和解协议书,这样协议有法律效应,首先对方不会继续提供法律文件,导致A,B店铺有风险,其次假如亚马逊扫到你A,B账号欺诈性dmca,你有和解协议书,这个是有法律效应的,到时候假如被扫了,可以申诉A和B
 
被美国公司投诉版权侵权,提交dmca之前一定要考虑清楚,毕竟对方在美国,起诉或者提供法律文件比投诉人是国内的方便的多
